New Procedure Resolving Disagreements

 

 

USSSA is a non-profit, sanctioning body for sports activities. USSSA adopts rules under which its sanctioned sports should be played. USSSA, however, does not direct or control the specific actions of Directors, Activity Owners, Activity Producers, Facility Owners, Officials and other USSSA Affiliated Persons, all of whom with respect to the USSSA are independent contractors responsible for supervising their own actions and the actions of their employees.USSSA is not structured in a manner that would allow it to oversee the specific actions of each of the Directors, Activity Owners, Activity Producers, Officials, Facility Owners and other USSSA Affiliated Persons. Unlike some sanctioning bodies, USSSA views Coaches as customers of USSSA Affiliated Persons. Coaches bring their teams to USSSA sanctioned activities.Participants, Teams, Sponsors, Related Parties etc. are likewise viewed as customers of the USSSA Affiliated Persons who are in charge of USSSA sanctioned activities.

 

As a non-profit sanctioning body, the USSSA receives minimal compensation for sanctioning events.As such, USSSA is not in a position to participate in the legal disputes that seem to occur on a more frequent basis with each passing year between Coaches, Participants, Teams, Sponsors, Related Parties Facility Owners, Activity Owners or Producers, Directors, Officials, other USSSA Affiliates ,etc.USSSA does not belong in these disputes. In addition once lawyers have been retained in a dispute, it is the view of the USSSA that continued interaction between parties to a legal dispute creates the risk of additional disputes and the possibility of improper communications between otherwise represented parties.

 

Therefore to address these matters, effective April 5, 2004, any Participant, Team, Coach, Sponsor, Related Party, USSSA Affiliate, etc., who threatens in writing to hire a lawyer or to otherwise take legal action against the USSSA, files a legal action against the USSSA, or has a lawyer contact USSSA regarding a dispute, shall automatically be suspended from all USSSA activities until such legal discussions with the USSSA are concluded to the satisfaction of the USSSA.In addition if a legal action is filed against USSSA or a USSSA Affiliated Person by a Participant, Team, Coach, Sponsor, Related Party, or any other person, the person filing the action, that personís (or any Related Partyís) team and each of its members may be suspended from all USSSA activities until such legal actions with the USSSA are resolved to the satisfaction of the USSSA.
